Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, applications, software, artificial intelligence features, APIs, messaging services, and other products and services provided by Parker Beaumont Holdings LLC ("Parker Beaumont," "we," "our," or "us"). By creating an account, downloading, installing, accessing, or using any Parker Beaumont service, you agree to these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
1. Eligibility
You must be legally capable of entering into a binding agreement. Minors may use a Service only with the consent and supervision of a parent or legal guardian unless a specific Service states otherwise.
2. Our Services
Parker Beaumont develops consumer and business software, AI-powered tools, cloud services, and mobile applications. Features differ between products and may be added, modified, suspended, or discontinued. Product-specific terms supplement these Terms and control only where they conflict.
3. Accounts
You agree to provide accurate information, protect your credentials, promptly notify us of suspected unauthorized access, and remain responsible for activity occurring through your account unless prohibited by law.
4. Acceptable Use
You may not violate laws, infringe another person's rights, interfere with security, upload malicious code, abuse AI features, scrape or overload Services without authorization, circumvent technical protections, or use the Services to harm Parker Beaumont, other users, or third parties.
5. Communications
By requesting SMS, email, push notifications, or other communications, you consent to receive service-related messages. Message frequency varies. Standard carrier charges may apply. You may opt out where supported without affecting required account or security notifications.
6. SMS/MMS Feedback Program
Parker Beaumont operates a text-based feedback line that lets users voluntarily text our published feedback number to submit app feedback, bug reports, screenshots, and feature requests. This service is conversational feedback and customer support, not promotional messaging, and this Section governs your use of it.
- Message frequency varies based on your feedback and our responses.
- Message and data rates may apply, based on your mobile carrier plan.
- Reply STOP at any time to opt out of further messages from this service. Reply HELP for assistance. Opting out stops future automated messages unless you later opt back in by texting the number again.
- Message delivery is not guaranteed and may be affected by carriers, device settings, or service outages.
- Do not submit illegal, malicious, infringing, or highly sensitive information through this service.
- Screenshots and other attachments may contain personal information. Remove unrelated sensitive details before sending.
- By submitting feedback, you grant Parker Beaumont permission to use that feedback to investigate and improve its products, consistent with Section 7 (User Content).
- Submitting feedback does not guarantee a response, fix, feature, or timeline.
- This service is not for emergencies or safety-critical requests. Do not use it to report an emergency; contact appropriate emergency services instead.
7. Artificial Intelligence
AI features, including Athena, generate probabilistic output that may be inaccurate, incomplete, or unsuitable for your circumstances. AI output is provided for informational purposes only and should not replace qualified medical, legal, financial, tax, engineering, fitness, coaching, or other professional advice. Never rely on AI alone in emergencies or safety-critical situations.
8. User Content
You retain ownership of your content. You grant Parker Beaumont a limited non-exclusive license to store, process, transmit, analyze, and display that content solely to operate, secure, synchronize, improve, and provide the requested Services.
9. Intellectual Property
All Parker Beaumont software, branding, interfaces, documentation, and related materials remain our property or that of our licensors and are protected by applicable law.
10. Third-Party Services
Some features rely upon third-party providers including mapping, cloud hosting, payment processors, AI providers, fitness platforms, weather providers, and communication services. Those services remain subject to their own terms and privacy policies.
11. Paid Services
Where fees apply, you agree to pay disclosed charges and applicable taxes. Subscription, renewal, cancellation, and refund terms presented at purchase become part of this agreement.
Purchases made through Apple are billed to the user's Apple Account and are subject to Apple's applicable payment, cancellation, and refund rules. Parker Beaumont does not directly receive or store complete payment-card information for purchases processed by Apple. Except where required by law or the applicable platform's policies, purchases are non-refundable.
12. Availability
Services are provided on an 'AS IS' and 'AS AVAILABLE' basis. We do not guarantee uninterrupted availability and may perform maintenance, updates, or security actions without prior notice where necessary.
13. Suspension
We may suspend or terminate access for violations of these Terms, fraud, abuse, unlawful activity, security concerns, non-payment, or legal requirements.
14. Disclaimers
To the fullest extent permitted by law, Parker Beaumont disclaims all express and implied warranties, including merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement. AI output, GPS, weather, health, financial, document, and analytical features are estimates only and are not guaranteed.
Routes, navigation instructions, weather information, traffic conditions, road or trail availability, and safety conditions may be incomplete, delayed, or inaccurate. Users remain responsible for observing their surroundings, obeying laws and posted restrictions, avoiding unsafe or inaccessible areas, and deciding whether conditions are appropriate for an activity.
15. Limitation of Liability
To the fullest extent permitted by law, Parker Beaumont will not be liable for indirect, incidental, consequential, exemplary, special, or punitive damages, including loss of data, revenue, profits, goodwill, workouts, documents, or business opportunities. Our maximum aggregate liability shall not exceed the greater of the amount paid for the applicable Service during the preceding twelve months or US$100 where permitted by law.
16. Indemnification
You agree to indemnify and hold harmless Parker Beaumont from claims arising from your misuse of the Services, violation of these Terms, infringement of another person's rights, or content you submit.
17. Governing Law
These Terms are governed by the laws of the State of Florida. Unless applicable law requires otherwise, disputes shall be resolved in courts located within Florida.
18. Changes
We may update these Terms periodically. Continued use of the Services after revised Terms become effective constitutes acceptance of the updated Terms.
19. Severability
If any provision is held unenforceable, the remaining provisions remain in full force and effect.
20. Entire Agreement
These Terms, the Privacy Policy, applicable purchase terms, and any product-specific terms constitute the entire agreement between you and Parker Beaumont regarding the applicable Service.
